Performance- All work will be done in accordance with the currently accepted industry standards as published by the International Society of Arboriculture (ISA) and The American National Standards Institute (ANSI). We cannot assume responsibility for delays brought on by reasons beyond our control such as inclement weather, labor, public safety, equipment problems, or unforeseen hazards in your tree(s).
Cabling and Bracing- These systems are designed to reduce potential limb or trunk failure risk. GreenTree Arborists does not guarantee that any support system will prevent limb or tree failure or reduce damages if failure does happen. Once cables or braces are installed, the tree and installed support systems need to be inspected annually.
Tree Risk Evaluation- We will provide observations and information regarding your trees during the normal course of business. This information does not constitute an official industry-standard safety and risk evaluation. Any comments made, whether either written or oral, are not official statements of the current or future safety risk of any tree. A written Tree Risk Assessment can be performed upon request and for an additional cost.
Tree Ownership- The Client warrants that all trees and plants included in this work order are located on his/her property, and if not, that he/she has obtained written permission from the owner to allow GreenTree Arborists to perform the prescribed work. The Client agrees to indemnify GreenTree Arborists for any damages or costs incurred as a result of mistaken ownership.
Client Responsibilities- On the day of the agreed upon work, as our client, it is your responsibility to have the work site free of vehicles, equipment, household items, animals, animal waste, obstructions, and to remove or disclose other hazards before we arrive. Examples of hazards can include underground utilities, landscape irrigation, concrete, and other foreign bodies in trees and plants. The Client also agrees to keep all people away from the work area and to notify immediate neighbors of the work to be performed. If the Client fails to disclose any hazard, warrant ownership, or receive permission to perform the work, GreenTree Arborists may, at their discretion, either charge the client for the additional time required to complete the work or choose to cease operations and remove workers and equipment from the area at a charge of $150.00 per hour per person.
Photography- We routinely take photographs and videos of our work and the trees we work on for educational and marketing purposes. Please inform us if you do not want images from your job to appear on our social media and/or website.
Disputes- In the event of a dispute, both parties agree to first, in good faith, participate in mediation before filing an action in court. If a suit is subsequently filed by either party, both parties agree to reasonably mitigate their costs.
This agreement shall be governed by and interpreted in accordance with the laws of the State of Oregon.
